About The Position

Incumbent serves as Part‑time Law Clerk for the Hamilton County Judicial Services/Court Administration, responsible for researching, drafting memos, reviewing pleadings, case law and statutes, preparing materials, drafting of Orders, and preparing memorandums.

Requirements

  • Bachelor’s degree and current enrollment (full-time or part-time) in an accredited law school.
  • Practical knowledge of civil and criminal law and legal processes, both state and federal, and strong electronic and paper legal research skills
  • Working knowledge and ability to perform research to find relevant cases, statutes, and resources.
  • Working knowledge of and ability to compose and type CCS entries and Orders based on the pleadings in case file and/or proposed Orders submitted by counsel.
  • Working knowledge of standard office policies and procedures with computer skills, including word processing, spreadsheet, presentation, email, internet, and Department-specific software systems, and ability to apply such knowledge to a variety of interrelated processes, tasks, and operations.
  • Working knowledge of standard filing systems and ability to create and maintain accurate and organized files and records.
  • Working knowledge of standard English grammar, spelling, and punctuation, and ability to prepare correspondence and detailed reports as required.
  • Ability to provide public access to or maintain confidentiality of Department information and records according to State requirements.
  • Shall comply with all employer and Department policies and work rules, including, but not limited to, attendance, safety, drug-free workplace, and personal conduct.
  • Ability to understand, memorize, retain, and carry out written or oral instructions and present findings in oral or written form.
  • Ability to work alone with minimum supervision and with others in a team environment, work on several tasks at the same time, and work rapidly for long periods, occasionally under time pressure.
  • Ability to properly operate standard office equipment, including computer, printer, calculator, digital recording equipment, and telephone.
  • Ability to effectively communicate orally and in writing with co-workers, other County departments, Judge, attorneys, and the public including being sensitive to professional ethics, gender, cultural diversities, and disabilities.
  • Ability to be flexible in job duties and cooperative with other staff members and Judge.
  • Ability to competently serve the public with diplomacy and respect, including occasional encounters with irate/hostile individuals.
  • Ability to plan/layout assigned work projects.

Responsibilities

  • Performs legal research as requested by the Judge and in preparation for hearings on motions and trials.
  • Reviews current legal decisions issued by the Indiana Supreme Court and/or the Indiana Court of Appeals.
  • Reviews current statutes and state and local court rules.
  • Prepares memorandums for the Judge on all motions and in advance of bench and jury trials, including summaries of all briefs or pleadings filed, current law, and/or any unanswered questions, providing listing and summary of pending motions to be heard by the Court and/or pending motions that will be affected by outcome of such hearing.
  • Provides the Judge with summary of case and legal proceedings in lengthy and/or complex cases, including providing the Judge with summary of existing law in matters that arise in front of the Court.
  • Attends all required hearings, including ensuring proper recording of hearings on FTR, including applying proper labeling, organizing, and documenting evidence that is admitted into Court.
  • Generates detailed proposed orders for the Judge's approval, including receiving, organizing, and reviewing proposed Orders submitted to the Court by counsel.
  • Prepares legal preliminary and final civil and criminal jury instructions, including updating the Court's standard set of criminal and civil preliminary and final instructions as updates are made to the Indiana Pattern Jury Instructions.
  • Assists the Judge in reviewing motions made.
  • Performs various clerical duties such as organizing case files and ensuring case entries are made for cases as needed.
  • Makes phone calls to attorneys regarding objections, settings, clarification of pleadings filed, or other inquiries as directed by the Judge.
  • Answers questions from the public and attorneys carefully, avoiding dispensing of legal advice.
  • Serves as backup to the Receptionist in their absence or as requested.
  • Performs other duties as requested by the Judge.
